Temporary Restraining Order Blocking Congestion Pricing Extended to January 31st!

Great News!! On January 17th, a judge ordered that the Temporary Restraining Order Blocking Congestion Pricing will be extended until January 31st! That means there will be no fee for the entire month of January!

Congratulations to the plaintiffs who filed the lawsuit and to the hundreds of NYTWA members who filled the streets and packed the courtroom on January 17th as the judge heard the case on the fee!

While the state's attorneys argued to have the case dismissed, the Judge actually extended the restraining order until a January 31st hearing, giving us more time to pressure the Governor, Assembly Members and state Senators to exempt yellows and greens from CP!

Drive in a motorcade into Albany to ask State Senators and Assembly Members to permanently exempt yellow and green taxis from the congestion fee!  We will circle in protest around the Capitol Building, hold a press conference and visit legislators. 

Without the exemption, we all know yellow and greencab driver families will face major bankruptcy and eviction crisis, destroying thousands of lives.  On the other hand, winning the exemption lets us fight for a Raise for All Drivers by establishing the same minimum meter rate for yellow, green and Apps - $3.30 initial, $3/mile and 60c per minute.  App drivers would get minimum 80% of the fare! The new App rates starting on Feb. 1 are a good start, but our campaign for a real raise continues!

Two more things about our January 17th Rally on the court steps: First:  there were yellow owner-drivers and lease drivers, greencab, App, livery and black car drivers.  Many Uber/Lyft drivers came in solidarity, just like yellow owner-drivers stood in solidarity at the TLC public hearing on App driver payment rules.

Second:  so many members organized each other for the rally.  Drivers were texting on WhatsApp groups, calling friends, made their own copies of the flyer and posted them at airports and restaurants.

We, brothers and sisters, are a real movement.  We cannot be stopped or divided.  And together and active, we will always make victory possible!

If Congestion Pricing starts, we will not be able to raise the yellow/green meter rates and that will make it harder for App drivers to also get a raise. The New TLC App Driver Rates are an average 11% raise per fare. It's a start, but not enough!

The New TLC App Driver Pay Rates were supposed to start January 11, 2019 but were delayed to Friday February 1, 2019. We are keeping up the pressure on the City and the Companies to stop any further delays!

Summary of App Driver Pay Rates + Other Income Protections We Won
Starting February 1, 2019:

App Driver Payment:

App companies must pay drivers using the following minimum rates on each trip. (There is no extra commission taken from the driver. All goes to driver to pay vehicle and other expenses.)

  • Distance: $1.09 per mile

  • Time: $0.495 per minute

  • Out of Town Trips

    • Distance: $1.262 per mile

    • Time: $0.574 per minute

  • Group Ride Bonus: amount to be decided

These rules mean Uber, Lyft, etc. can no longer cut the rates on drivers! We finally have a floor to stand on! TLC's rates are higher on some trips than what Uber and Lyft pay today. Based on our analysis, it's an average 11% raise. Remember, we keep up the fight for more, and a raise for ALL DRIVERS!

App Company Enforcement:
· In addition to responding to driver complaints, TLC will audit trip records on a regular basis.
· Will require high volume FHVs to submit data on a regular basis to assist in audits and future policymaking
App Company Transparency:
· Requires bases to hold on to records for three years.
For Yellow and Green Cab Drivers:
· Credit card processing fee reduced from $11 to $7 / shift
· Increase coming in Accessible Dispatch & TIFF payments: to be announced on website
· Eliminate cap on payments for SHL Accessible grant program
· Include all yellow WAV's in programs (including accessible medallions)
· Require garages & brokers pay insurance claims to drivers who paid for repairs
· Require garages to give drivers credit on the lease when car is late. Allows garages to lease taxis for less than 12 hour shifts at pro-rated lease amount
· Requires taximeters to show total added amount

OUR DEMAND: EXEMPT YELLOWS & GREENS FROM $2.50/$2.75 CONGESTION PRICING TAX!  

The congestion pricing fee will add $2.50 for every yellow taxi trip that begins, ends or touches 96th St and below. 

So if the trip is from Brooklyn to the Bronx and you pass through Manhattan the $2.50 will be added.  For green cabs, it will be $2.75. Apps meanwhile can charge just 75 cents if fares are available for group rides. 

More than 90 percent of yellow taxi trips will be effected at time of historically low earnings, and skyrocketing bankruptcies and evictions. Drivers will be working only for the state, not our families and ourselves. It will be impossible to get a raise on the meter.  

Governor Cuomo can fix this: Exempt yellow and green cabs the same way liveries were exempted in 2009 from the 50 cent MTA tax because it would have created a hardship for them.

Apply that principle today to struggling yellow and green cabs.  If yellow and green industries are crushed, Wall-Street-financed Apps like Uber and Lyft will have more power against App drivers. Our organizing for better working conditions will become much harder.  Already we have lost 8 of our brothers to suicide.

We have to stand together, as one for all, all for one.

Even the Taxi and Limousine Commission has said that this fee would have a devastating impact on yellow taxi drivers. 

Just like yellow taxi drivers and Uber drivers united to create a wage floor for app drivers and to put a cap on Uber, we need to unite together now to stop Uber from destroying the lives of more of our brothers.

Today, Bloomberg News published an article on how congestion pricing could devastate the yellow cab sector.

Even congestion pricing supporters see through this attempt to help Uber monopolize Manhattan. And our Uber driver brothers know that yellow taxi drivers will be hurt the most:

"We can avoid Manhattan and still make money," said Saibou Sidibe, who was a cabbie for over a decade before switching to Uber several years ago. "For yellow taxi drivers, Manhattan is the only place."   

The article also highlighted our daily protest line outside the governor's office leading up to our rally on Wednesday:

Every day last week, a small group of taxi drivers stood in front of Governor Andrew Cuomo's office in Manhattan, holding signs that said things like "Congestion Pricing = My Bankruptcy," and urging passing drivers to attend a larger rally planned for Wednesday.  Many cabbies laid on their horns, presumably in support, as they drove by.

Since 2009, yellow and green cab drivers have contributed $1 BILLION for the MTA! Yellows and greens already give 50c for every trip and pay a vehicle lease sales tax that goes toward the MTA. Uber, Lyft, and other Apps, meanwhile, will get a break of 75cents for group rides, even if the car has only one passenger.

This Congestion Pricing Plan will not reduce congestion, or raise much money as the industry goes bankrupt. This plan is just a road map to make it easier for Wall Street's Uber and Lyft to monopolize as they go for their Initial Public Offering (IPO) in 2019.

AT THIS TIME OF CRISIS: Call for yellows and greens to be exempt!  Driver Unity won the Vehicle Cap and won the first-time regulations to give App drivers a raise.  Stay united.  Together, we can win this fight for yellow and green driver brothers and sisters who will be devastated by this surcharge.  Once we win this fight, then we can be in line for a raise for all drivers with one minimum meter rate with higher fares (Initial $3.30; $3/mile; 60c/minute slow traffic) and 80% to drivers - no matter what car you drive! 

We are already winning support at the TLC! At the Dec 4th TLC hearing, Chairperson Joshi said NYS should pause Congestion Pricing until there is a plan to also charge private cars. Other Commissioners added that there should be emergency action to stop it!  The Governor's Department of Taxation and Finance can also speak the truth that they do not have a way to implement this surcharge. As regulators, they can call for a delay, while the Governor calls Albany back to order to vote on an exemption.

VICTORY for Uber/Lyft, ALL App Drivers! TLC Passes Minimum Rates By Which Companies Must Pay App Drivers!

The TLC passed these minimum rates that companies must pay App drivers for each trip! This means that Uber/Lyft & co. can’t cut the rates!

NO MORE UBER AND LYFT CUTTING RATES! Since our protests in February 2016 when Uber cut rates, we have been fighting for these rules! With these new rules, Uber and Lyft can no longer cut the rates on drivers' backs. Uber, Lyft drivers will gross 11% more per trip on average and the rates will be doubled on out of town trips (which is straight from NYTWA's proposal)!

The rules passed, and Commissioner Marino called for higher rates with 80% to drivers, supporting our Raise for All Drivers Demands! Chairwoman Meera Joshi responded that she believes TLC rules will eventually get there! So we have a first giant step and the stage set for our ultimate victory!

For yellow and green cab drivers, the TLC showed support by refusing to vote on Congestion Pricing! They also voted to lower the credit card fees and increase WAV payments! Our Unity Brings Home the Victory!

Today, we celebrate our steps forward and better understand TLC's new rules. Tomorrow, get ready to hit the streets and stop the attack of Congestion Pricing so we can win a real Raise for All Drivers!
